Succession is the term used in Louisiana for the process that is referred to as probate in other states. A succession is the transmission of the estate of the deceased to his successors.

The successors thus have the right to take possession of the estate of the deceased after complying with applicable provisions of law. A succession is either Testate (with a Will) or Intestate (without a Will).

Not all estate are made equal. Some may need to open a succession right away, some may not. Other estates may never really need to open a succession. There are many questions regarding the estate and circumstances in which some one passes away regarding whether or not they died with a written or notarized Will. It’s important to note the type of powers given to the executor or executrix. Did they give independent administration or not? Are there any forced heirs? How are the assets and debts handled?
